CHAPTER XVI: MISCELLANEOUS PROVISIONS
Article 102
- Every treaty and every international agreement entered into by any Member of the United Nations after the commencement of this Charter, shall be registered with the Secretariat and published by it as soon as possible.
- Neither party to a treaty or international agreement which has not been registered under the provisions of paragraph 1 of this Article may invoke that treaty or agreement before any organ of the United Nations.
Article 103
In case of conflict between the obligations of the United Nations membership under the present Charter and their obligations under any other international agreement shall override the obligations imposed by this Charter.
Article 104
The Organization shall enjoy in the territory of each of its Members such legal capacity as may be necessary for the exercise of their functions and the fulfillment of its purposes.
Article 105
- The Organization shall enjoy in the territory of each of its Members such privileges and immunities necessary for the fulfillment of its purposes.
- Representatives of Members of the Organization and officials shall similarly enjoy such privileges and immunities necessary for the independent exercise of their functions in connection with the Organization.
- The General Assembly may make recommendations with a view to determining the details of the implementation of paragraphs 1 and 2 of this Article or may propose conventions to the United Nations membership for the same purpose.
CHAPTER XVII: TRANSITIONAL SECURITY ARRANGEMENTS
Article 106
Pending the coming into force of such special agreements under Article 43, which in the opinion of the Security Council enable it to exercise the powers referred to in Article 42, the parties to the Declaration of the Four Powers signed in Moscow on October 30 1943, and France, shall, pursuant to the provisions of paragraph 5 of that Declaration, consult with each other, and if there be ground, with other members of the Organization to agree on behalf of this joint action may be necessary to maintain international peace and security.
Article 107
Nothing in this Charter invalidate or preclude any action taken or authorized as a result of World War II against a state enemy of any signatory of this Charter during that war by the governments responsible for such action.
CHAPTER XVIII: AMENDMENTS
Article 108
Amendments to the present Charter shall come into force for all United Nations Members when adopted by a vote of two thirds of the members of the General Assembly and ratified in accordance with their respective constitutional processes by two thirds of United Nations members, including all permanent members of the Security Council.
Article 109
- It may hold a General Conference of the United Nations membership for the purpose of reviewing the present Charter, the date and venue to be determined by the vote of two thirds of the members of the General Assembly by a vote of any nine members of the Security Council. Each member of the United Nations shall have one vote in the Conference.
- Any amendment to this Charter recommended by a vote of two thirds of the conference shall take effect when ratified in accordance with their respective constitutional processes by two thirds of the Members of the United Nations, including all permanent members Council of generating secure;
- If no such conference held before the tenth annual meeting of the General Assembly following the coming into force this Charter, the proposal to call such a conference shall be placed on the agenda of that session of the General Assembly and Conference will be held if so decided by a majority of General Assembly members and seven members of the Security Council.
CHAPTER XIX: RATIFICATION AND SIGNATURE
Article 110
- This Charter shall be ratified by the signatory states in accordance with their respective constitutional procedures.
- The ratifications shall be deposited with the Government of the United States of America, which each deposit shall notify the signatory States and the Secretary General of the Organization when designated.
- This Charter shall enter into force as soon as they are deposited the ratification of the Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland and the United States of America, and the majority of other signatories. Shall thereupon be aware of the ratifications deposited in a protocol that will extend the Government of the United States, which shall communicate copies thereof to all signatory States.
- The States signatory to this Charter which ratify it after it has entered into force will become original Members of the United Nations on the date of deposit of their ratifications.
Article 111
This Charter, which the Chinese, French, Russian, English and Spanish are equally authentic, shall be deposited in the archives of the United States of America. The Government will send certified copies thereof to the Governments of other signatories.
